please… there is a local lawyer that everyone loves because he is so friendly and speaks English.  When the lady died and the daughter came here he showed her the will that gave everything to him.  She had to leave the big house and not take anything.  All of the Mexican neighbors knew this but not the gringo community.   Be careful

We had a Mexican will made by a local notario and have a well known local attorney as our executor for Mexican assets.  She has a copy of our notarized will and will take care of distributing assets to listed charities.  The funeral home has the notario's info as well as the executor's info and they will be notified at the appropriate time.  In the contract we have with the lawyer, it is spelled out a small % that will be earned for handling the estate on our behalf.  We don't have children nor any other family who is remotely interested in coming to Mexico to handle this for us when the last one goes.  Our US assets have a US will and family beneficiaries. Seems like an easy method to insure our wishes are adhered to but this is Mexico so...just do the best you can.

Alan, just a question....  how does your situation.... a well known local attorney.... differ from the one Daisy2013 shared?  No matter what your 'contract' says, when after your deaths the attorney flashes a Will saying that he/she is the recipient of your assets aren't all bets off?

In France they just arrested a notario,,we have the same sytem as here , who made 5 millions euros in no time, redoing the wills of people who did not have family,  for himself.. and France is a little lesss crooked than Mexico so ,, anything can happen anywhere..

My suggestion is that if anyone has a will prepared by a local notario, then it would be most prudent to locate a capable attorney to review the will with you line by line.  A certified translator and lawyer at lakeside that I plan to use is Anna Siller.  The attorney and notario who are most often recommended on this webboard have neither been honest nor capable with my legal issues.  YMMV.

If you were not so much into your little world , you  would understand that the Mexican legal system came from Europe   that is the connection.. we have notaries there like Mexico does... France and Germany influenced the Mexican legal system, England did not... Obviously you do not know much about the differnt cultures  and have a tunnel vision. Notarios are important people.. and even in countries where corruption is less prevalent , things happen.

First of all , the will doesn't say she gets our assets.  Nor does the contract.  It simply says she has the right to handle sales of assets, arrange distribution to listed charities, and after the notario handles the house sale she will get a small % for handling it for us.  Secondly, how do any of us, once dead, know if anybody is going to do the right thing with assets once we are gone?  Lots of stories about loved ones fighting over and even faking will information for personal profit.  I feel like we've done what we can to insure our wishes will be met.  I think faking a will to change beneficiaries will be close to impossible since only one notarized will exits and several folks involved with our deaths have copies of the same will. 

I'm not going to worry about it anymore.

We have known about 3 instances where people have had a legal entity (Notario or lawyer) prepare a will for them in MX.  One person died and found out the Will had not been recorded so wasn't valid.  One person died and the lawyer used a Power of Attorney that the person who died had signed, we think without knowledge, and changed all documents giving them, the lawyer, the power to do with their assets as they chose.  Needless to say, the home of these people was taken over by the attorney who did not pay HOA dues, rented the house and it is a real mess now.  Another person we know died and the lawyer disregarded all previous documents about how to deal with their home and assets and told the relatives NOB that the person that died left everything to the lawyer.  IMHO it isn't wise to let anyone but a close friend or relative have any say in what happens to your assets after you die.

  • France like many other European countries has certain virtues and qualities of life but winning wars is not one of them. Whilst America did not win World War 1or II alone ....without the United States the wars against Axis fascism would have been lost
  • In 2022 over 35,000 illegal immigrants left the French paradise for the UK, and the numbers continue to increase..

Not to mention the fact that it was the French who entered the Revolutionary war in 1775 on behalf of the Americans and broke the British Naval blockade.  George Washington's army would have been destroyed in a matter of a few months had the French not intervened on their behalf.
